Terms of Service

DirtBid ("the Service") is a construction cost-estimating platform for site work in the United States, operated by DirtBid ("we", "us"). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of a company, you represent that you can bind that company to these Terms.

This section matters more than any other. Estimates, soil analyses, hazard flags, unit prices, and reports produced by the Service are planning-level screening tools. They are NOT: a geotechnical report, an engineering opinion, a survey, a bid guarantee, or professional advice of any kind. Soil characterizations derive from public data (USDA-NRCS soil surveys and county-level records) that varies parcel to parcel. A site-specific investigation by licensed professionals governs all design, pricing, and construction decisions. You are solely responsible for every bid you submit and every business decision you make using output from the Service.

Parts of the Service use artificial intelligence, including supplementary price lookups, plan analysis, and the scope assistant. AI output can be wrong. AI-sourced prices are labeled with their source and confidence, and prices outside our reference ranges are flagged — but the responsibility to verify pricing before relying on it is yours.

You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. Free Preview accounts include limited allowances (a limited duration, a small number of projects, and a soil preview showing the risk score, top hazards and soil names only), as described at signup; paid products and plans unlock full reports per the pricing page.

You own the project data, estimates, and documents you create. You grant us the limited rights needed to operate the Service (storage, processing, backup, and display back to you). We do not sell your data. See the Privacy Policy for details.

Do not: abuse, probe, or overload the Service; access other users' data; resell or scrape the cost database; use the Service for unlawful purposes; or reverse engineer the platform. We may suspend accounts that do.

One-time products (Soil Report, Land Screening, extra parcels) are charged when ordered and delivered in the app. Paid plans are billed in advance on a monthly or annual cycle and renew automatically until cancelled. You may cancel anytime; access continues until the end of the paid period and no partial refunds are given. Prices may change with 30 days' notice. All purchases are final and non-refundable except where required by law. Before every payment you are asked to confirm that you have read this policy and the Estimate Disclaimer; we keep a record of that confirmation with the payment.

DirtBid estimates and soil reports are built from public data (USDA-NRCS soil surveys, county records) and a Virginia regional cost model. They are intended for early-stage budgeting and feasibility only and are not a bid, a quote, a geotechnical investigation, a survey, or professional engineering advice. Real costs depend on site conditions, plans, market pricing and contractor scope, and can differ materially from any estimate. Verify with your own licensed engineers, surveyors and contractors before buying land, submitting a bid or signing a contract.

If a report failed to generate, a payment was charged twice, or you believe there is an error in your order, email support@dirtbidai.com within 7 days and we will make it right.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that estimates will match actual costs or that the Service will be uninterrupted or error-free.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost bids, cost overruns, or construction losses arising from use of the Service or reliance on any estimate or report. Our total liability for any claim is limited to the amount you paid us for the specific report or, for subscriptions, the most recent billing period.

Civil engineers, surveyors, geotechnical and environmental firms, land use attorneys, lenders, architects and insurers may apply to be listed as a Partner under DirtBid estimates in the regions they choose. These terms apply in addition to the rest of this document when you hold a partner listing. Approval. Every application is reviewed by DirtBid before it goes live. We may decline or limit an application at our discretion, and we may cap the number of listings per category and region. Free period and billing. A listing starts with a card on file. The first 7 days are free, the free period begins when the listing goes live, and you can cancel before day 7 at no charge. After that the plan renews automatically, monthly or annually, until cancelled. Each company receives one free period. Cancelling removes your listing at the end of the paid period; no partial refunds are given. Nationwide pricing is repriced at each renewal, and other prices may change with 30 days' notice. Where a listing is sold at launch (introductory) pricing, that price is kept for at least 12 months from the day the listing goes live; after that DirtBid may move the listing to the regular price with 30 days' notice. What a listing is. Every partner card is labelled Sponsored. A listing is advertising placement only: DirtBid does not endorse, vet the licensing of, or guarantee the work of any partner, and does not promise any number of views, clicks or introductions. Introductions. When a DirtBid user asks to be introduced to you, you receive their contact details plus the project county, approximate acreage and a budget range. You may use that information only to respond to that request. You may not resell it, add the person to marketing lists without their consent, or share it outside your company. Your content. You are responsible for the accuracy of your company name, description, logo and licence claims, and you grant DirtBid a licence to display them in the app, on public share pages and in estimate PDFs while your listing is live. Removal. We may pause or remove a listing for non-payment, inaccurate information, complaints from users, or conduct that harms DirtBid or its users.

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination we will make your data available for export for 30 days unless the law requires otherwise.

We may update these Terms; material changes will be announced in the app or by email, and continued use constitutes acceptance. These Terms are governed by the laws of the Commonwealth of Virginia, USA.
